High Court overrules the Magistrate Court order that sentenced a school girl to 250 days in prison

Ampara Provincial High Court Judge Sumudu Premachandra today overruled the 250 day mandatory jail term passed by Ampara Magistrate on a 17 year old school girl.

In addition, the High Court judge further ordered the 7 thousand rupees fine imposed on the girl to be paid by the government, and to hand over the girl to be placed on Probation.

Ampara Additional Magistrate Keminda Perera sentenced the school girl to 250 days in prison under the charges of possessing 510 grams of marijuana.

The girl was arrested with marijuana at Damana area in Ampara on the 3rd of March.

Accordingly, the Magistrate court took the case for hearing and ordered her a 250 days mandatory jail term.

However, the student’s faction filed an appeal in the Ampara Provincial High Court.

The High Court then overruled the order given by the Magistrate court.

The Provincial High Court Judge has stated that the verdict was given after considering the student’s maximum well being.

High Court Judge Sumudu Premachandra in his order further explained that it was not justifiable to sentence a jail term to the girl when she had initially pleaded guilty, and that the initial court hearing has neglected the capacity to place the girl on probation.
