Supreme Court Judge Rohini Marasinghe issued this order today after considering 11 fundamental rights petitions that state certain magistrates go out of their judicial powers to impose penalties on suspects.
11 detainees serving prison terms complained in their petitions that such incidents have been reported from several magistrate courts.
A Magistrate Court has authority to impose prison terms that limits to four years but the petitioners state certain Magistrate Courts have imposed prison terms that runs from 34 to 66 years.
Having considered the petitions, Supreme Court Judge Rohini Marasinghe said if such prison terms have been imposed, it could create a serious situation.
At the same time, the Justice Minister Wijedasa Rajapaksa has been ordered to ascertain whether such prison terms have been imposed and, submit facts with regard to such prison terms, if any.
