Italy’s highest court of appeal has ruled that food theft, in small amounts, is not a crime if the individual is hunger.

The move comes when judges overturned a theft conviction against a homeless man, Roman Ostriakov, for stealing cheese and sausages, worth $4.50, from a supermarket. He was caught when he attempted to leave a supermarket with two pieces of cheese and a packet of sausages without paying in 2011.

In 2015 he was convicted of theft and sentenced to six months in jail.

Now, Court of cassation has decided that Ostriakov had stolen the food ‘in the face of the immediate and essential need for nourishment.’
