Mulativu Magistrate rejects to summon Shavendra Silva

The Mulativu Magistrate rejected to summon Major General Shavendra Silva who commanded the 58th Division during the war, in connection with the disappearance of 12 LTTE members including one of its leaders, Elilan, believed to have surrendered to the army.

Wife of Elilan and Northern Provincial Council member Anandi Shashidaran, who filed a habeas corpus, cited at the beginning that the group including her husband surrendered to the army but later stated they disappeared. 

The habeas corpus was taken before Mulativu Magistrate M. Samsudeen yesterday.

The Commander of the 58th Division Major General Kalinga Gunawardana told the Court, that he was unaware of any surrendered persons as the Division was commanded by Major General Shavendra Silva during the war.

Accordingly, the lawyer appeared for Shashidaran requested Courts to summon Major General Shavendra Silva before Court.

However the Magistrate stated that he is not able to summon Major General Shavendra Silva before Courts due to majority objections.

He also said that a final decision will be announced over the matter when the Case is called again on April 27th.
