Criminal Investigation Department has taken into custody the computer system containing phone call recordings at the Perpetual Treasuries Limited.

It was revealed at the Presidential Commission of Inquiry probing the Central Bank Bond Issue today (29), that the CID took the system into their custody last afternoon.

The CEO of PTL, Kasun Palisena was testified before the Commission today.

After suspending it for a while, the Senior Additional Solicitor General of the AG's Department, PC Dappula de Livera submitting a special motion before the Commission, told that the company that installed the voice recording system has informed them that the relevant voice recorder has reinstalled after its data have been interfered with.

De Livera said that they decided to taken into custody the voice recorder after it was found that the data were manipulated.

It was found that PTL has reinstalled this data system on the 6th of July, the date in which that the Central Bank suspended the business activities of the PTL.

On that date, the Monetary Board of the Central Bank, acting in terms of the Regulations made under the Registered Stocks and Securities Ordinance and the Local Treasury Bills Ordinance, decided to suspend Perpetual Treasuries Limited from carrying on the business and activities of a Primary Dealer for a period of six months.

The Attorney General’s Department requested the Bond Commission to take legal action against Perpetual Treasuries Limited and its CEO for providing false information before the Commission.

The Attorney General’s Department proved before the Commission that the sound recordings, supported by an affidavit provided to the Commission were false.

Perpetual Treasuries CEO Kasun Palisena repeatedly told before the Commission that no other information is available in the system other than sound recordings.

He supported his statement with an affidavit.

However, the company which installed the sound recording system for Perpetual Treasuries stated today (29) that the system generally records all incoming call numbers and the time they are received.

The chief engineer of the system installation company Nalin Ranga Dharma stated that Palisena has lied before the Commission.

In addition, engineer Ranga Dharma stated that Perpetual Treasuries has breached the service agreement with his company by re-installing the software.

This was proved by the Indian company, which developed the particular software for Perpetual Treasuries.

However, the Attorney general’s Department stated that the Central Bank of Sri Lanka has temporarily suspended the business activities of the Perpetual Treasuries.

The witness stated that other than the audio recordings in connection with the transactions during the controversial bond issue, the rest of the recordings have been removed from the system when it was re-installed.

After this information was revealed, the CID has taken this computer system into its custody yesterday.

At this moment, Additional Solicitor General Dappula de Livera requested the Commission to issue an order to take legal action against Perpetual Treasuries CEO for providing false information even with the support of an affidavit and misleading the Commission.

Lawyers appearing for Perpetual Treasuries Limited are scheduled to give explanation with regard to the matter tomorrow.
