"Cannot compel PTL owner to be testified" - Bond Commission

The Presidential Commission of Inquiry probing the controversial Central Bank Bond scam decided today it cannot compel owner of Perpetual Treasuries Limited Arjun Aloysius to testify before the Commission, if he is not willing to do so.

However, the Commission stressed that Aloysius is a crucial witness in the bond controversy.

Then the Commissioners also said Arjun Aloysius can give evidence if he is willing to do so.

This decision was taken after Arjun Aloysius’s lawyer argued that the Commission has no legal provisions to question his client.

The Commission also issued a 9-page document, which included the legal reasons as to why Aloysius could not be forced to give evidence before the Commission.

It stated that it wanted Arjun Aloysius to testify before the Commission as the controversial bond issuance is intermingled with several sensitive issues such as placing abnormal biddings, disclosure of receiving Central Bank internal information by the company sound recordings, the relationship between the then Central Bank Governor Arjun Mahendran and Perpetual Treasuries owner Arjun Aloysius and the rapport the company had maintained with certain top officials of the Central Bank.

In addition, the Commission report states that it paid its attention to a telephone call made to a head of a certain private commercial bank when a witness was testifying and, a payment made by Arjun Aloysius for the rental of a luxury apartment occupied by a former minister Ravi Karunanayake.

The lawyer of Arjun Aloysius argued that the Attorney General has power to name his client as an accused in a future course of legal action, therefore such an accused cannot be compelled to testify before the Commission. 

Meanwhile, the Commission also issued summons to former Central Bank Governor Arjun Mahendran to appear before the Commission on 19th of September.
