The Fundament Rights petition filed against Provincial Council Elections (Amendment) Act before Supreme Court by former Chief Justice Sarath N. Silva has been rejected.
 
It was dismissed by the majority of a 3-member bench, even without granting leave to proceed.
 
The bench comprised of Chief Justice Priyasath Dep, Justice Nalin Perera and Justice Buwaneka Aluwihare.

Former Chief Justice Sarath N. Silva filed his Fundamental Rights petition on 28th of September last year.

He requested the Supreme Court to issue a decree announcing the manner in which the Provincial Council Elections (Amendment) Act was passed in Parliament in last May, was illegitimate.

The petition by Sarath N. Silva noted that passing the draft bill by a two-thirds majority in Parliament without holding a referendum is contravened to the Constitution.

The Speaker, the Attorney General and the Chairman of the Election Commissioner were named as respondents in the petition.

Announcing the decree in open Court, Chief Justice, Priyasath Dep said that the petition is rejected without granting leave to proceed on the majority decision of the three-member bench of Judges.
