REMOVAL+OF+DENISWARAN+FROM+THE+POSTS+OF+NORTHERN+PROVINCIAL+COUNCIL+MINISTER+IS+ILLEGAL.+COURT+OF+APPEAL+ASKS+EX-+CHIEF+MINISTER+TO+PAY+LEGAL+FEES

The Court of Appeal decided that the decision taken by former Chief Minister C V Wigneswaran to remove Northern Provincial Councilor P. Deniswaran from his post of Minister of Fisheries and Transport in the Northern Provincial Council was against the constitution.

The decision was delivered today by Justices Mahinda Samayawardena and Priyantha Fernando when the case was taken up for hearing.

Accordingly, the Court of Appeal ruled that the replacement made by the former Chief Minister instead of Deniswaran is also illegal and that the Chief Minster had no power to make such an appointment. 

Former Minister Deniswaran had filed a writ petition in Court of Appeal asking the court to declare his dismissal as illegal.

The petition further stated that the former Chief Minister removed him in August 2017 after levelling corruption charges against him.  

Therefore, the bench of the Court of Appeal declaring the verdict ordered the former Chief Minister Wigneswaran to pay the assessed legal fees to the former minister Deniswaran.

Meanwhile, the case against Bodu Bala Sena (BBS) Secretary General Galagoda Aththe Gnanasara Thero for defaming the Quran has been postponed until December 2.
