Court of appeal suspends an order given by two courts against Gotabhaya

The order issued by the Colombo Chief Magistrate Court and the High Court rejecting the preliminary objections filed by former defence secretary Gotabhaya Rajapaksa in the Avant-Garde case was suspended by the Court of Appeal today.

Judges of the Court of Appeal, Achala Vengappuli and Arjuna Obeysekera announced their decision after considering the Gotabhaya Rajapaksa’s petition that challenged the ruling issued by the Magistrate and High Court.

Actions had been filed against the former defence secretary and several others alleging that they caused a loss of 11.4 billion rupees to the government by giving permission to Avant-Garde Maritime Service Company to run a floating armoury in the Galle harbour.

Later, Gotabhaya’s lawyers filed preliminary objection citing that the procession to take legal action was unlawful but it was rejected by the Colombo Magistrate.

Later, the lawyers filed a revised application with the Colombo High Court and it was also rejected.

However, the petition filed by Gotabhaya Rajapaksa against the judgments by the two courts was granted leave by the Court of Appeal. Accordingly, the previous two judgments were suspended by the Court of Appeal today.
