APPEAL COURT DISMISSES THE PETITION AGAINST GOTABHAYA’S CITIZENSHIP

The Court of Appeal dismissed the petition which was filed challenging the citizenship of SLPP presidential candidate Gotabhaya Rajapaksa this evening.

Two civil activists, Professor Chandragupta Thenuwara and Gamini Viyangoda filed the petition.

The petitioners requested the Court to issue a stay order on accepting the citizenship of former defence secretary and SLPP presidential candidate Gotabhaya Rajapaksa.

The petition was taken for hearing before a three-judge bench for the third day today.

It was considered by justices Yasantha Kodagoda, Arjuna Obeysekera and Mahinda Samayawardana.

Lawyers appearing for the petitioners argued that the then President Mahinda Rajapaksa had not possessed necessary power to sign off on the citizenship certificate for Gotabhaya Rajapaksa.

Contrary to their argument, the lawyers appearing for the respondent argued that such powers were vested in the then President Rajapaksa soon after he was sworn in as the executive president in November 2005.

Attorney-at-law Suren Fernando appeared for the petitioners while President Counsel Romesh de Silva appeared for the respondent Gotabhaya Rajapaksa.

Presidents Counsel Gamini Marapana appeared for the Opposition Leader Mahinda Rajapaksa.

Having considered the submissions made by both factions, the three-judge bench decided to dismiss the petition.
