The Writ Petition filed requesting the prevention of the premature dissolution of the Eastern Province Provincial Council is scheduled to be taken up for hearing before the Appeal Court today.
The five-year period of the Eastern Province Provincial Council is due to end on 10th May, 2013.
A resident of Damana has filed this petition requesting that an order be issued to the Provincial Governor preventing the dissolution of the Provincial Council before that date.
Eastern Province Governor Rear Admiral Mohan Wijewickrema, Eastern Provincial Council Ministers Navaratna Raja, L S Subaseer, Meeraa Saibu and Wimalaweera Dissanayaka have been named as respondents in this petition.
According to the regulations of the Constitution, dissolution of Provincial Councils should be done in accordance with the Chief Minister's instructions.
The petitioner states that the Chief Minister has no legal authority to instruct the Governor to dissolve the provincial council when the council's expressed consensus is that it should not be dissolved.
