President s decision about appointing CJ cannot be challenged;AG informs the Supreme Court.

Attorney General Paalitha Fernando told before the Supreme Court that no one had the legal right to question or challenge in court the appointment of the Chief Justice.

That was when the Fundamental Rights petition the Alternate Policy Centre had filed against the appointment of Chief Justice Mohan Peiris to that position was considered before a five-member bench of judges yesterday.

The Attorney General informed on this occasion that according to the constitution the appointment of the Chief Justice was carried out by the President.

On this occasion the Attorney General said that accordingly it was not possible to file any case with regard to an action performed by the President. 

The AG also pointed out on this occasion that the constitution itself provides a special privilege and assurance to the President to be free from such cases.

Attorney General Paalitha Fernando said further before the Supreme Court that because of this reason the Supreme Court had rejected a number of cases filed earlier too from time to time.
