The Seven judge panel which heard the petitions against the dissolution of parliament, unanimously decided that the Gazette issued by the President dissolving parliament is unconstitutional.

Delivering the judgment, Chief Justice Nalin Perera said that parliament cannot be dissolved until a 4 and a half year term is completed.

 Other judges who sat in the panel are Priyantha Jayawardana, Prasanna Jayawardana, Sisira de Aabrew, Vijith Malalgoda, Buwaneka Aluvihare and Murdu Fernando.

The UNP, JVP, SLMC, All Ceylon People’s Congress, Tamil Progressive Alliance and a member of the Election Commission Rathnajeeva Hoole and several other factions filed petitions against the president’s controversial Gazette which was issued on November 9.

The petitioners stated that their fundamental rights were violated by the premature dissolution of parliament.

Another 10 factions also filed petitions requesting them to permit to mediate in the hearing.

Before the announcement of the judgment today, the seven judge panel heard the petitions from December 4 through four days until last Friday.
